Is It Legal to Buy from a Dispensary in Durham?

Yes. Every dispensary listed here sells hemp-derived products legal under both federal law (2018 Farm Bill) and NC state law (Session Law 2022-32 / SB 455). Products must contain ≤0.3% Delta-9 THC by dry weight. No medical card, prescription, or special license is needed.

Many shops enforce a 21+ age policy. There is no state-level age requirement for hemp purchases in NC today; this is store policy, not law.

North Carolina status, October 10, 2026: HB 328, the state hemp crackdown, passed the Senate in July but still awaits a House vote, which can come in the reconvened sessions between October 26 and December 18. Federal change coming: P.L. 119-37 (signed November 2025) redefines hemp based on total THC and adds a 0.4mg total THC per container cap. For nearly every product, that takes effect December 11, 2026, and it will restrict most THCa, Delta-8, and Delta-9 products.

Update, October 10, 2026: The federal hemp deadline referenced below has shifted. H.R. 6500 became Public Law 119-103 on September 2, 2026, and its Section 2019 delays most of the new hemp definition, including the 0.4mg per container THC cap and the total-THC test that counts THCa, to December 11, 2026.
